Our Terms of Use
1.1 This Website is operated by Bowel Cancer New Zealand (BCNZ, we, us and our).
1.2 BCNZ is a registered charitable trust in New Zealand (CC44166). Our mission is to reduce the impact of bowel cancer through awareness, education, advocacy, support and research.
1.3 These Terms of Use set out the rights and obligations between you (the person or organisation accessing or using the Website) and us. Please read these Terms together with our Privacy Policy.
1.4 By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the Website.
Defined words in these Terms of Use
Content means any software, data, information, images, graphics or other materials available on the Website, including third-party content.
GST means goods and services tax under the Goods and Services Tax Act 1985.
Intellectual Property Rights means all rights in patents, trademarks, copyright, designs, know-how and other intellectual property.
Unacceptable means anything defamatory, harmful, offensive, misleading, unlawful, or otherwise inappropriate.
User means any person who accesses or uses the Website.
Website means www.bowelcancernz.org.nz and any related BCNZ websites.
Your use of the Website
3.1 You agree to:
(a) comply with all applicable laws;
(b) only access parts of the Website you are authorised to use;
(c) follow any notices or instructions on the Website.
3.2 You must not:
(a) misuse the Website or attempt to interfere with it;
(b) upload or share Unacceptable content;
(c) infringe the rights of others;
(d) introduce viruses or malicious code;
(e) scrape or harvest data;
(f) use the Website in a way that damages or disrupts it.
Fundraising in support of BCNZ
4.1 You may choose to fundraise in support of BCNZ. By doing so, you acknowledge that you are fundraising in support of BCNZ only, and are not authorised to represent, act on behalf of, or make commitments for BCNZ.
4.2 All fundraising activities must be approved by BCNZ in advance, unless clause 4.3 applies.
4.3 If you create a fundraising page using a platform approved by BCNZ, this will be deemed approval for fundraising conducted solely through that platform.
4.4 Any fundraising conducted outside of an approved platform (including events, cash collections, or other activities) must receive explicit prior approval from BCNZ.
4.5 You agree to comply with BCNZ’s Fundraising Guidelines (as updated from time to time).
4.6 BCNZ may refuse, withdraw, or revoke approval for any fundraising activity at its discretion.
4.7 BCNZ is not responsible for the organisation, conduct, or outcomes of fundraising activities undertaken by individuals or organisations in support of BCNZ.
Payments and donations
5.1 There is no fee to use the Website.
5.2 The Website may allow you to make payments, including donations or purchases.
5.3 Unless stated otherwise, all amounts are in New Zealand dollars and include GST where applicable. Donations do not include GST.
5.4 Payments are processed by independent third-party providers. By making a payment, you agree that:
(a) additional bank or processing fees may apply; and
(b) you are responsible for any payment defaults.
5.5 We may share necessary personal information with third-party providers to process payments, in accordance with our Privacy Policy.
5.6 All donations are voluntary and are non-refundable, except in limited circumstances at BCNZ’s discretion. Any request for a refund must be made in writing to info@bowelcancernz.org.nz and must include proof of payment.
5.7 Donations of $5 or more may be eligible for a New Zealand donation tax credit. BCNZ will issue receipts by email and can provide printed receipts on request.
5.8 If you set up a recurring donation, you may cancel it at any time, either through the method provided or by contacting BCNZ.
5.9 Where donations are made via a fundraising page, you acknowledge that all funds are paid directly to BCNZ, not to the individual fundraiser.
Our responsibilities and liability
6.1 To the maximum extent permitted by law:
(a) we do not guarantee the Website will be available, accurate, complete, or error-free;
(b) we may update or change the Website at any time;
(c) we are not responsible for reliance on information provided through the Website;
(d) we are not responsible for any information provided by BCNZ staff, volunteers, support nurses, or healthcare professionals;
(e) we are not responsible for the organisation or outcomes of fundraising activities conducted by third parties in support of BCNZ.
6.2 Where liability cannot be excluded, our maximum liability is limited to NZD $500.
6.3 You agree to take reasonable steps to ensure that your use of the Website complies with these Terms, and you are responsible for any loss or damage caused by your breach of these Terms.
Third-party services
7.1 The Website may include links to third-party websites or services. These are provided for convenience only.
7.2 BCNZ may use third-party platforms for payments, fundraising, or data management. Your use of those services is subject to their own terms and policies.
7.3 BCNZ is not responsible for the availability, performance, or security of third-party services.
User content
8.1 You may submit content to the Website (including fundraising pages, images, and text).
8.2 By submitting content, you grant BCNZ a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, and share that content for promotional and awareness purposes.
8.3 You acknowledge that:
(a) fundraising pages may be publicly visible; and
(b) BCNZ is not responsible for how content is accessed or shared by others.
8.4 You must ensure that any content you submit:
(a) is accurate and not misleading;
(b) does not infringe any rights; and
(c) includes appropriate consent if it features another person.
8.5 We may remove or modify content at our discretion.
Communications
9.1 If you choose to receive communications from BCNZ, we may contact you by email or other channels you have opted into.
9.2 You can unsubscribe or opt out of communications at any time using the instructions provided or by contacting us.
Intellectual property
10.1 BCNZ (or its licensors) owns all Intellectual Property Rights in the Website and its Content.
10.2 You may not use our branding, logos, or materials without prior written consent.
Health information disclaimer
11.1 Information on this Website is provided to support awareness and understanding of bowel cancer. It is general information only and is not medical advice.
11.2 You should not rely on this information as a substitute for professional medical advice.
11.3 If you have any concerns about your health, you should seek advice from a qualified healthcare professional.
12. Digital tools, symptom checker and referrals
12.1 The Website may include tools and features such as symptom checkers, chat functionality, referral forms, and other interactive services (Digital Tools).
12.2 These Digital Tools are provided to support awareness, education, and access to BCNZ services. They are informational only and are not intended to provide medical advice, diagnosis, or treatment recommendations.
12.3 The symptom checker is designed to help you identify potential symptoms and encourage appropriate next steps. It does not assess your individual health condition.
12.4 Information provided through the chatbot or other Digital Tools is based on general Website content and may not reflect your personal circumstances.
12.5 You may use referral forms on the Website to request support from BCNZ. Referrals may be submitted by individuals, healthcare providers, or, where appropriate, family members or carers.
12.6 By submitting a referral, you confirm that:
(a) the information provided is accurate to the best of your knowledge; and
(b) where you are submitting information about another person, you have their consent to do so, or are otherwise authorised to provide that information.
12.7 Information submitted through Digital Tools will be handled in accordance with BCNZ’s Privacy Policy.
12.8 Use of Digital Tools does not guarantee access to BCNZ services, which remain subject to eligibility, assessment, and availability.
Support services and patient information
13.1 BCNZ provides support services, including access to information and guidance from staff, volunteers, and support nurses.
13.2 These services are intended to provide general support and information only and are not a substitute for professional medical advice, diagnosis, or treatment.
13.3 BCNZ staff, volunteers, and support nurses do not provide clinical diagnoses or treatment recommendations.
13.4 You are responsible for seeking advice from a qualified healthcare professional in relation to any medical concerns or treatment decisions.
13.5 To the maximum extent permitted by law, BCNZ is not responsible for any outcomes arising from reliance on support or information provided.
Funded support services
14.1 BCNZ may provide access to funded support services, including financial assistance and access to healthcare providers.
14.2 Financial assistance may be available once per 12-month period, unless otherwise agreed by BCNZ.
14.3 Where vouchers or financial support are provided:
(a) vouchers may only be used for approved purposes (such as food or petrol);
(b) vouchers must not be used for tobacco, alcohol, or other excluded items unless approved;
(c) proof of diagnosis may be required;
(d) vouchers must be used within the specified timeframe and no later than 12 months from issue;
(e) vouchers are not transferable and cannot be exchanged for cash;
(f) BCNZ is not responsible for vouchers that are lost, stolen, or destroyed and these will not be replaced;
(g) identification may be required when using vouchers.
13.4 BCNZ may arrange access to third-party service providers. These providers are independent and responsible for the services they deliver.
13.5 BCNZ’s role is limited to facilitating access to support services. To the maximum extent permitted by law, BCNZ is not responsible for the quality or outcomes of services provided by third parties.
13.6 BCNZ’s support services and programmes are subject to availability, eligibility criteria, and funding limitations.
13.7 BCNZ may prioritise, defer, decline applications, or operate waiting lists where demand exceeds available resources.
Updates to these Terms
14.1 We may update these Terms at any time by publishing an updated version on the Website.
14.2 Continued use of the Website means you accept the updated Terms.
General
15.1 These Terms and our Privacy Policy form the entire agreement between you and BCNZ.
15.2 We may suspend or terminate access to the Website if you breach these Terms.
15.3 These Terms are governed by New Zealand law.
15.4 If any part is invalid, the remaining Terms continue in full force.
